South Carolina is unable to enforce a 2008 anti-illegal immigration law because the federal Department of Homeland Security has denied access to a program to verify a worker’s citizenship, Gov. Nikki Haley said Friday.
The administration said they have not been able to enforce the South Carolina law since April 29. DHS has told the state they do not believe South Carolina businesses can access the federal e-Verify system to check worker citizenship, but Haley said she has been able to discuss the issue with DHS director Janet Napolitano.
“They continue to get in the way of me governing this state,” Haley said. “They can’t be serious about illegal immigration if they won’t allow us to enforce the law.”
The U.S. Supreme Court ruled Thursday states can enforce immigration laws – typically the domain of the federal government.
